A few days ago, the case of liquor smuggling was in the headlines, just 6 kilometers from Katihar Junction. Apart from this, illegal liquor in unclaimed condition has also been confiscated from various trains during the checking campaign at various railway junctions of Bihar. At the same time, after the amendment in the prohibition law, the Bihar government has again appealed for reconsideration in the Patna High Court.
Amendment was done in the month of April
After the amendment in the prohibition law, now the state government has appealed to the Patna High Court to reconsider the power of the second class judicial magistrate. According to information received from B Karthikeya Dhanji (Commissioner, Prohibition, Excise and Registration Department), a letter has also been written to the Patna High Court in the past. It is worth noting that the prohibition law was amended in the month of April. According to the amendment, if a person is caught drinking alcohol for the first time, there is a provision to leave by imposing a fine of two to five thousand rupees. Special executive magistrates will have this action. Let us inform you that in this regard, the State Government had also deputed 392 notified Executive Magistrates in 38 districts. Along with this, the Patna High Court was also requested to give the power of second class judicial magistrate to these executive magistrates, but the High Court rejected it.

Appeal once again from Patna High Court
The state government has once again appealed to the Patna High Court to give the power of judicial magistrate. Along with this, guidance has also been sought from the High Court to make the Prohibition Amendment Act better. The bill to amend the liquor prohibition law in Bihar was passed by both the houses of the legislature in March this year. The Bihar Prohibition and Excise Amendment Bill-2022 was introduced in the House. The biggest amendment has been made in the old law of prohibition that instead of being sent to jail if caught drinking alcohol, there is also a provision to be released after paying a fine.
