Bharat Rashtra Samithi (BRS) MLA in ‘poaching’ case Telangana High Court has given a big blow on Monday. The High Court today dismissed the Telangana government’s plea challenging the transfer of the case to CBI allowing CBI probe. The Telangana government challenged the transfer of the case to the CBI. Thereafter, the High Court dismissed the petition challenging the case.
The High Court on Monday, February 6, dismissed an appeal challenging the transfer of the investigation into the poaching case of the MLAs to the Central Bureau of Investigation (CBI). A division bench of Chief Justice Ujjal Bhuiyan and Justice N Tukaramji dismissed the pleas of the state government and MLA Pilot Rohit Reddy to transfer the case related to the alleged poaching attempt to four MLAs of the Nation of India to the CBI. The order was challenged.
The Division Bench ruled that the order of the Single Judge Bench cannot be faulted and cannot be interfered with. The division bench’s order paved the way for a CBI probe into the sensational case. The High Court did not accede to the Advocate General’s request to stay the implementation of the order as the state government plans to challenge it in the Supreme Court.
On 27 December 2022, Justice B Vijaysen Reddy ordered the transfer of the horse-trading case to the CBI. The High Court had also quashed the government order under which a Special Investigation Team (SIT) was constituted by the state government to probe the matter.
