Delhi High Court bans Pakistani ‘Rooh Afza’ being sold on Amazon

Delhi High Court has banned the sale of Pakistani sherbet in the name of ‘Rooh Afza’ on Amazon. The ‘Rooh Afza’ brand is a brand owned by Hamdard Company in India. But Pakistani ‘Rooh Afza’ was being sold on this e-commerce site by many retailers. This decision of Delhi High Court came after a complaint made by Hamdard National Foundation (India).

The complaint filed by Hamdard National Foundation (India) said that Pakistan-made sorbet was being sold in India under the same brand name as the company. After which the High Court, while hearing the matter, ruled in favor of Hamdard. The company sells several products under this brand name worth over Rs 200 crore annually.

Hamdard, in his complaint, claimed that a company named Golden Leaf was selling its products on Amazon India under the brand name ‘Rooh Afza’. On all occasions the product was claimed to be manufactured by Hamdard Laboratories (Waqf) Pakistan.

Judge Pratibha Singh of the High Court said that, if any other case is found violating the ‘Rooh Afza’ mark of the plaintiff (Hamdard). This will be brought to the notice of Amazon India and will be removed in accordance with the Information Technology (Intermediate Guidelines and Digital Media Code of Conduct) Act.
