Law Minister Rijiju has made controversial remarks related to the judiciary. Union Law Minister Kiren Rijiju said that there are some (retired) judges who are activists and part of the anti-India gang. He said, such people are trying to turn the judiciary against the government. He said in a warning manner that such people who turn against the country will have to pay the price for it.

The Law Minister made the statement on the accountability of judges while answering questions at the India Today Conclave 2023 on Saturday. Referring to a recently held seminar, Kiren Rijiju said, “Recently one seminar was on the accountability of judges. But somehow the whole seminar revolved around how the executive is influencing the judiciary.” “There are some judges who are active and part of the anti-India gang who are trying to turn the judiciary against the government like the opposition parties,” he said.

Rijiju said, judges are not associated with political people in any way, so how can people say that there is a need for governance in the executive. He said that no one will be spared and those who go against the country will have to pay the price. On the collegium system and the appointment of judges, the Law Minister said, the audacity of the Congress governments by interfering in the appointments of judges gave birth to the collegium system.

He said, according to the Constitution, the appointment of judges is up to the government and the President will appoint Supreme Court and High Court judges in consultation with the Chief Justice of India and Chief Justices of the High Courts. However, the Congress party had the audacity to interfere in the Judiciary, due to which the collegium system came into existence. He said, till any new system is made for the appointment of judges, the central government will follow the collegium system.

The Law Minister said that the appointment of judges is an administrative function and the government will have to do due diligence. On allegations that the names were not cleared for a long time despite the collegium’s recommendation, Rijiju said, “I don’t want to talk about individual names and why the names are not being cleared… The collegium knows that we have cleared Why not and we also know why they insisted on names. I can answer it but it would not be appropriate to name anyone.

To a question on leave for courts and judges, the law minister said, “Judges need holidays as they deal with at least 50-60 cases daily along with administrative duties. According to Rijiju, judges in the US Disposes 4 to 5 cases. Judges in India have 50 to 60 cases a day. There are days where judges hear 100 cases. There is a lot of mental pressure on them. is also needed.

The ‘struggle’ of the executive and the judiciary

Responding to a question, Law Minister Rijiju said, in his view, “struggle” is not the right word. He said “In a democratic set up, there will always be differences. There will be issues between the three organs which will run against each other, but it is not correct to say that there is conflict, we have always stood by the independence of the judiciary and the judiciary should Strengthening as well.”

Why the government is against gay marriage

Recently, the issue of gay marriage which reached the Supreme Court has also been discussed a lot. Law Minister Rijiju clarified the government’s stand on this. On opposing same-sex marriage, he said, Parliament is a reflection of people’s vision and people’s choice. Therefore, the question of how the institution of marriage should operate needs to be debated in Parliament.

Significantly, the Constitution Bench of the Supreme Court gave a historic judgment on the appointment of the Election Commissioner of India (ECI). The decision states that the members of the commission should be appointed on the advice of a committee. What does the government think on this? In response, the Law Minister asked, “If the CJI or judges of India decide every appointment, then who will carry out judicial work?” At the same time, he also made it clear that he was not criticizing the decision. However, he also emphasized that judges are primarily there to pass judicial orders and perform work related to the judiciary.
