New Delhi, June 20: The Punjab-Haryana High Court has given a different verdict regarding the marriage of a Muslim girl. Referring to Islamic Shariah rule, the court said that the marriage of a Muslim girl takes place under the Muslim Personal Law. Because of this a Muslim girl above the age of 16 is free to marry a person of her choice. Apart from this, the court has directed the Pathankot police to provide security to the petitioners.

According to the petitioners, their marriage took place on June 8, 2022, according to Muslim customs. Although his family was not ready for this, due to which he is getting constant threats. So he has moved the High Court. The petitioner gave the girl’s age as more than 16 years and her age as 21 years. Along with this, in his petition, he demanded to be provided security to both.

The petitioner said that as per Article 195 of the book ‘Principles of Mohammedan Law’, petitioner 2 i.e. the girl is more than 16 years of age, so she is competent to marry a boy of her choice. Apart from this, the age of the boy is also 21 years. Thus both the petitioners are of marriageable age as envisaged by the Muslim Personal Law.

During the hearing of the matter, a single bench of Justice Jasjit Singh Bedi observed that just because the petitioners have got married against the wishes of their family members, they cannot be deprived of the fundamental rights of the Constitution of India. Apart from this, the apprehensions being raised by the petitioner need to be allayed. The High Court ordered SSP Pathankot to provide security to the couple and take necessary action as per law.
