The Supreme Court on Wednesday remarked during a hearing on the Election Commissioner that the country needs a Chief Election Commissioner who can take action against the Prime Minister if needed.
A 5-judge bench headed by Justice KM Joseph said during the hearing that suppose there are allegations against the Prime Minister and the Chief Election Commissioner has to take action. But the commissioner is weak. He doesn’t act. Isn’t this like a failure of the system?
The CEC is supposed to be insulated from political influence and should be independent. These are the aspects which you should consider deeply… Why do we need an independent larger body for selection and not just the cabinet,” the apex court said.

The top court said that several committees have pointed out that there is a dire need for change. Leaders also shout from outside but nothing happens.
A day before this, during the hearing, the Supreme Court had said that there is a need for a strong Chief Election Commissioner like late TN Seshan. A five-judge bench headed by Justice KM Joseph also includes Justices Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy and CT Ravikumar. The Constitution Bench said that the endeavor of the hearing is to establish a mechanism by which the best person can be selected.

The bench said that there have been many Chief Election Commissioners and there are few like TN Seshan. Three people (two Election Commissioners and one Chief Election Commissioner) have a huge responsibility on their shoulders. We have to find the best man for the post of Chief Election Commissioner. The question is how do we find that best man and hire that best man.”
Earlier on Tuesday, there was a hearing on this matter in the Supreme Court in which the court asked that no Chief Election Commissioner has completed the term of six years.
