Supreme Court on Upper Cast Reservation: The Supreme Court has given its verdict on the petitions challenging the validity of the 103rd Constitutional Amendment giving 10 percent reservation to the poor ‘Savarnas’. The Supreme Court has said that the decision of reservation on economic basis will continue. Chief Justice of India Uday U Lalit says four judgments are to be given on the constitutional validity of reservation for Economically Weaker Sections (EWS) in higher education and public employment issues based on financial conditions. Justice Dinesh Maheshwari and Justice Bela M Trivedi upheld the validity of the 103rd Amendment Act 2019 of the Constitution, which gives 10% reservation to poor ‘Savarnas’.
Justice Dinesh Maheshwari said that reservation on economic grounds does not violate the basic structure of the Constitution. Justice Bela M Trivedi says, his decision is in concurrence with Justice Maheshwari and says that the EWS quota in the general category is valid and constitutional.
